This action was commenced in the district court of Carter county, Okla., by Miller and Jones Brothoers, a copartnership, defendants in error, plaintiffs below, against Baker and Strawn, a copartnership, plaintiffs in error, defendants below, to recover damages for breáeh of contract to drill two oil and gas wells in Carter county.
The parties will be referred to in this opinion as plaintiffs anid defendants, as they appeared in, the lower court.
