OPINION

PAYNE, Justice.

This petition for certiorari arose from the reversal of two separate convictions of the defendant, Mark Chouinard. The Court of Appeals also ordered the defendant discharged. 96 N.M.-, 635 P.2d 986. We reverse.

The defendant was indicted on September 21,1977, on nine counts of trafficking in cocaine. He failed to appear for arraignment and was not apprehended and arrested on the indictment until May 15, 1979.
