I. INTRODUCTION
' On September 24, 2003, Plaintiff Merrill Lynch, Pierce, Fenner & Smith Inc., filed a Motion for Temporary Restraining Order and Preliminary Injunction seeking to enjoin Defendant Ross T. McClafferty from violating portions of his employment agreement with Merrill Lynch. The court 1 heard the matter on September 26, 2003. Theodore Young, Esq., appeared for Merrill Lynch.
