MEMORANDUM OPINION

BRITT, District Judge.

This action was instituted in the Superior Court of Warren County, North Carolina, on 16 August 1979 by Warren County against the State of North Carolina; Herbert Hyde, Secretary of the North Carolina Department of Crime Control and Public Safety; Harlan Boyles, Treasurer of the State of North Carolina; and Carter C. Pope and wife, Linda W.
