Thomas Younger instituted this action on behalf 'of himself and others similarly situated by filing a complaint in which he demanded relief on two counts. Count one of the complaint alleged, inter alia, that defendant Glamorgan Pipe and Foundry Company (hereinafter Glamorgan) (a) maintains a policy or practice of discriminating against plaintiff and other Negro persons similarly situated because of race or color with respect to compensation, terms, conditions and privileges of employment; (b) limiting, segregating and classifying the…
