BATCHELDER, Circuit Judge.
Robert Putney (“Putney”) appeals the district court’s order dismissing under Federal Rule of Civil Procedure 12(b)(6) Counts Two through Seven of Putney’s Second Amended Complaint in this action brought pursuant to the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq., and Ohio law.
