Appellant was indicted, tried and convicted of the offense of theft of- cattle, and sentenced to two years confinement in the penitentiary.

1. The question presented by bill of exceptions Ho. 1 presents the most serious question in the case. Appellant was charged with the . theft of one head of cattle, the property of A. D. Middleton. A.
