Plaintiff instituted this suit seeking (1) a preliminary injunction enjoining the Defendant, Upshur Rural Electric Cooperative Corporation, which Defendant will hereinafter be referred to as the Co-op, from serving or taking any steps toward serving electric consumers . in the city limits of the Defendant, City of Gilmer, Texas, in addition to those being served by the Co-op as of the time . the Defendant City granted a franchise to the Co-op on July 15, 1954; (2) judg- . ment declaring null and void a franchise, hereinafter more particularly described, , that the City…
