The statement of the case by appellants is adopted: The appellee instituted this suit in the District Court of Dallas County, Texas, on December 10, 1894, alleging that he was trustee in a certain trust deed or chattel mortgage made by Bulgin & Company, a firm composed of Frank Bulgin and L. S. Garrison, to secure certain creditors of said firm, upon a certain stock of goods, wares and merchandise, situated in the city of Dallas, Texas; that the appellee, as trustee, and also the creditors- secured in said deed of trust, accepted the same on May 29, 1894, on the day…
