On February 10, 2003, plaintiff/claimant Hospital Service District No. 1 of the Parish of Lafourche, doing business as Our Lady of the Sea General Hospital (“Our Lady of the Sea” or “the provider”), filed a complaint against Tommy Thompson, Secretary of the Department of Health and Human Services (“the Secretary” or “DHHS”), seeking review of the Secretary’s decisions to deny reimbursement claims sought under the Medicare Supplementary Medical Insurance Program (“Medicare”).
