For convenience we will refer to plaintiff’s assignor as “ plaintiff The complaint sets np four alleged causes of action, only two of which survive for our consideration. The first count, which runs against defendants Air Conditioners Sales Corporation, Air Conditioners, Inc., and Marr, alleges a promise by those defendants to plaintiff to pay him a commission for services to be performed by him.
