Statement of the Case

Plaintiff, H. E. Gardner, a resident of Navarro County, Texas, sued Amerada Petroleum Corporation, a Delaware corporation (hereinafter called Amerada), and the Celeste Scott heirs, residents of Texas, for title and possession of Lot 11, Block 37, of the Bloomington Townsite, in Victoria County, Texas, free -and clear of an oil and gas lease claimed by Amerada; also, William F.
