Appellee, Interkal, Inc., is a beneficiary-materialman of the trust created in section one of TEX.REV.CIV.STAT.ANN. art. 5472e (Vernon Supp.1983).1 Appellant, Re-publicBank Dallas, N.A., is a bank within the meaning of section four of the Act. Both claim a superior right to money received by a contractor for the construction and remodeling of gymnasiums.
