There have been three trials of this case in which plaintiff is seeking to recover damages for injuries sustained when his motorcycle collided with a locomotive operated by defendant, Los Angeles Junction Railway Company. The first trial, in which the Atchison, Topeka and Santa Fe Railway Company was joined as a defendant, resulted in a judgment of nonsuit; on appeal the judgment was affirmed as to Santa Fe and reversed as to Junction Railway.
