Peterson appeals a judgment of conviction of homicide by intoxicated use of a vehicle in violation of § 940.09(l)(a), Stats.; four counts of causing injury by intoxicated operation of a motorboat in violation of § 30.681(2)(a), Stats.; and failing to render aid in a boating accident that involved an injury of great bodily harm in violation of § 30.67(1), Stats. On appeal, he contends that the trial court erroneously excluded from evidence a videotape that demonstrated the conditions on the river at the time of the accident.
