The plaintiffs in error brought this action of assumpsit against the defendant on the following instrument of writing:

Belleville, Ill., 1st August, 1860.

$10,000. On or before the 1st day of August, 1861, the county of St. Clam, Ill., promises to pay John F. Anderson & Co., of St. Louis, Mo., the sum of ten thousand dollars, for value received, negotiable and payable, without defalcation or discount, at the Bank of Commerce in New York city, with interest from date at the rate of ten per cent, per annum.
