Defendant in error, Leander J. McCormick, brought assumpsit in the superior court of Cook county against the plaintiffs in error, Anthony F. Seeberger and others, as co-partners, to recover rent accruing" from August 15, 1893, to May 1, 1895, upon a lease made by McCormick to the Market National Bank of Chicago of a certain office, to be used exclusively for the purposes of a bank. The rent stipulated in tlie lease was $13,000 per annum, payable $1083.33 monthly. Besides the common counts the declaratipn contained a special count declaring" specially on the written lease.
