This suit was commenced on the 9th day of August. 1906, in the district court of Garfield county, Oída. T., by the Attorney General, in the name of the territory of Oklahoma, by filing a petition therein, which alleged, in substance, that the Chicago, Rock Island & Pacific Railway Company is a corporation, incorporated in one of the states or territories of the United States, which one is unknown to plaintiff, and operating a line of railroad in the county of Garfield and other portions of the territory.
