SPRIZZO, District Judge:

Pursuant to 42 U.S.C. § 1983, on November 8, 1994, plaintiff Anita D’Angelo, individually, as legal guardian of Anita Jean Yglesias, and as administratrix of the estate of Sonia Yglesias filed the instant action asserting constitutional claims and pendent state claims of wrongful death and fraud. Plaintiff’s claims arise out of the death of incarcerated prisoner Sonia Yglesias in 1982 while in the custody and care of defendants.
