ARCARA, District Judge.

This ease was referred to Magistrate Judge Leslie G. Foschio, pursuant to 28 U.S.C. § 636(b)(1), on February 16, 1996. On June 10, 1997, defendants filed a motion for partial summary judgment. On March 11, 1998, Magistrate Judge Foschio filed a Report and Recommendation, recommending that: (1) defendants’ motion for partial summary judgment be granted in part and that the survival actions pertaining to decedents Anthony J.
