I. INTRODUCTION

Plaintiff brings this action seeking relief for alleged violations of the Surface Mining Control and Reclamation Act of 1977, 30 U.S.C.A. §§ 1201-1328 (West 1986 & Supp. 1998) (“SMCRA”), by the Defendants. Specifically, Plaintiff asserts that the Defendants mined beyond their approved permitted mining underground (“PMU”) and caused damage to the surface of his property. The case is currently before the court on Defendants’ second motion for summary judgment as well as their motion for reconsideration. The court exercises…
