In the trial court Asa Perritt was the plaintiff and William S. Heindl was the defendant and in such relation they will sometimes be subsequently referred to.
The plaintiff instituted an action at law, by notice of motion, in the Law and Equity Court of the city of Richmond, against the defendant for damages in the sum of $20,000.00, for injuries sustained by reason of the alleged negligence of the defendant in so operating- his automobile as to cause him to be run over and knocked down and severely hurt, bruised and wounded.
