Plaintiff’s decedent, William B. Fore, was killed by the automobile of B. H. Bailey, the plaintiff in error, in the manner hereinafter described. His administratrix recovered a judgment confirmed by the court. The defendant was granted a writ of error by this court.
Fore, the deceased, was living, at the time of his death, on Church Hill, in the city of Richmond, Virginia, at 2903 East Clay street. He was employed, on the day of the accident, and for some eighteen years prior thereto, at the *613Richmond Cedar Works. The accident happened at about eleven o’clock P. M. on November 23, 1931.
