MEMORANDUM OF DECISION RE: CROSS-MOTIONS FOR SUMMARY JUDGMENT

The matters before the court are the above-referenced plaintiffs (the “Debtor”) and the above-referenced defendant’s (“Niagara Mohawk”) cross-motions for summary judgment in this adversary proceeding. 1 The court has jurisdiction over this adversary próceeding pursuant to 28 U.S.C. § 1334.
