Tbis is an appeal from an order of tbe district court of Ward county, granting a motion for a new trial on tbe ground of newly discovered evidence.

• Plaintiff brought action against tbe defendant Dougherty, chief of police of the city of Minot, to recover tbe value of an automobile alleged to have been converted by him. Tbe intervenor, husband of tbe plaintiff, claimed to be tbe owner of tbe car, and, on motion of Dougherty, filed a complaint in intervention asserting ownership. The defendant Dougherty seized tbe car, apparently upon notification from the intervenor that it was tbe property…
