Appeal by the defendant, The City of New York, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 27th day of June, 1903, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 23d day of June, 1903, denying the defendant’s motion for a new trial made upon the minutes.

Houghton, J.:

The plaintiff is a corporation engaged in the business of making plans and specifications and superintending the. erection of buildings as architect. Prior to the 25th day of October, 1900, a site had been duly selected for the erection of the Sixty-ninth Regiment Armory, between Twenty-fifth and Twenty-sixth streets, on Lexington avenue in the city of New York.
