The parties to this cause appear in the reverse of their trial positions. Their business relationship was that of insurer and insured. We shall so refer to them, or according to their trial positions, or by name,. us may be convenient.
H. M. Neumann was a grocery merchant located and doing business in the city of Guthrie. On March 15, 1925, the Sun Insurance Office insured' Neumann’s stock against loss by fire in an amount not to exceed the sum of $800, this being evidenced by its one year policy of insurance.
