The plaintiff in error, hereinafter called defendant, was convicted in the district court of Tulsa county of the crime of robbery with firearms, and Ms punishment fixed by the jury at imprisonment in the state penitentiary for 10 years.
The defendant complains of numerous errors, but for the purpose of this opinion it will only be necessary to consider bis fourth ground of error, which is:
