PERRY, District Judge.

By this action, the plaintiff, a citizen of the State of Illinois, seeks to recover the sum of ten thousand dollars for breach of contract from the defendant, an Ohio corporation. It is alleged that, on June 7, 1951, the parties entered into a contract whereby the plaintiff was appointed defendant’s exclusive sales agent for the entire State of Kansas, and was to receive a commission of 6% on all sales made by him in that State.
