McCORMICK, District Judge.

A corporate taxpayer, Pacific Coast Steel Company, brought this action at law in the District Court for the Northern District of California for the recovery of income and excess profit taxes for the calendar year of 1917, claiming that said taxes were illegally assessed and collected as deficiency taxes. Pursuant to stipulation, tho ease was tried by the court, sitting without a jury, and, upon special findings, a judgment was entered for the defendant.
