The defendant contracted to assign and sell certain oil and gas leases to the assignor of the plaintiff pursuant to the terms of a written contract entered into by and between the parties on the 8th day of February, 1918. The contract included both commercial and departmental leases. Oil was being produced from both the commercial and departmental leases at the time of the execution and delivery of the contract.
