Appeal from a judgment of the County Court of Rensselaer County (Harris, J.), rendered January 14, 1985, upon a verdict convicting defendant of the crime of sodomy in the first degree.

*792Defendant’s conviction of sodomy in the first degree stemmed from acts committed at his home on a nine-year-old boy on July 16, 1984 at about 9:00 p.m. These acts, consisting of both oral and anal sodomy, were witnessed by a 10-year-old boy who was a friend of the victim.
