The patent in suit, No. 580,281, to Frederic W. Hillard, issued April 6, 1897, application filed January 9, 1893, for new and useful improvements in typewriter escapements, contains 42. claims, 9 only of which are in issue; but these cover an invention, if it be that, which has gone into general use, commanded attention and respect, and forced a confession of its utility even from the defendants’ experts in this litigation.
