In a district court of Dallas county, appel-lee, Forrest Ledbetter, a minor, recovered judgment against Joe Scottino, appellant, in the sum of $3,750, damages for personal injuries received by appellee while in appellant’s employ. The appeal has been duly per fected to this court, and the following are the essential facts:
