The plaintiff brought this action of tort against the Bay State Grocery Company declaring in three counts: the first, as assignee by written assignment from John Ogonowsky (G. L. c. 231, § 5), for a conversion by the defendant in November, 1919, of goods of Ogonowsky; the second, for a conversion by the defendant in November, 1919, of goods of the plaintiff; and the third, as assignee by written assignment from Ogonowsky, for damages caused to Ogonowsky by the acts of the defendant in “maliciously and with intent to injure” Ogonowsky demanding from him as a debtor for goods purchased by him,…
