June 22, 1938, plaintiff gave notice to defendant of a claim for injury and on August 5th applied for compensation under the occupational disease statute (Act No. 61, Pub. Acts 1937 [amending Act No. 10, Pub. Acts 1912 (1st Ex. Sess.)], claiming he was suffering from silicosis contracted while in the employ of defendant; that such disease resulted from the nature of his employment; that the last injurious exposure to the hazards of this disease occurred after October 29,1937; and that he was then a trip rider in defendant’s coal mine.
