This is an original proceeding in the nature of quo warranto to determine the title to the office of clerk of the district, court in and for Yellowstone county. The relator is, and was at the times mentioned hereinafter, an elector residing in Yellowstone county. He was voted for as the regular candidate of the Republican party at the general election held on November 3, 1908, to succeed Fred H.
