Defendants' Hemsley and wife gave respondent a chattel mortgage on certain crops to be grown on respondent’s land, which mortgage was duly filed. The crops were, with respondent’s knowledge, harvested, and delivered by Hemsley to appellant, Sperry Elevator and Storage Company, hereafter referred to as appellant company, and shipped by them to their warehouse in Ogden, Utah.
