VARIAN, J. —
On June 5, 1929, and prior thereto, appellant, as a public utility, operated a fleet of eight passenger motor-busses within the corporate limits of the city of Boise and vicinity. On said date respondent issued to appellant a policy insuring appellant against liability for damages on account of accidental injury to pei’sons, including death, and for damage or destruction of property, resulting from accident during the policy term in the operation of its said busses.
