This is an action brought by the people of the state of New York against the defendant, a milk seller, to recover the sum of $200 as a penalty for violation of section 32, art. 3, c. 1, of the Consolidated Laws, known as the “Agricultural Law.” On the morning of July 16, 1909, two agents of the Commissioner of Agriculture, whose duty it was to detect violations of the agricultural law, saw a wagon bearing the name of the defendant stop in front of a lunchroom in the city of New York.
