Defendant was convicted by a jury for obtaining money by false pretenses in violation of ORS 165.205. He appeals contending that the trial court erred:(1) In overruling defendant’s demurrer to the indictment on the ground that the alleged false tokens were not false;(2) In failing to sustain defendant’s motion for a directed verdict of acquittal on the same ground;

*143(3) In the procedure which the court followed in instructing the jury; and(4) In accepting less than an unanimous verdict.

Defendant’s last assignment has been decided against him in State v. Gann, 254 Or 549, 463 P2d 570 (1969).
