LEON, District Judge.

Before the Court is a motion for a preliminary injunction [# 3] filed by a national community organization, the Association of Community Organizations for Reform Now (“ACORN”) 1 on behalf of several thousand evacuees of Hurricanes Katrina and Rita 2 and four individual Hurricane Katrina evacuees. 3 In essence, plaintiffs contend that the Federal Emergency Management Agency (“FEMA”) violated the due process rights of those hurricane evacuees who were denied long-term housing benefits under Section 408 of the Stafford Disaster Relief and Emergency…
