ORDER
NORTON, District Judge.
This action is before the court on Defendant’s Motion for Summary Judgment and to Strike. For the reasons set forth below, the court grants Defendant’s motion.
I. PROCEDURAL HISTORY
Plaintiff filed this complaint in the Court of Common Pleas on July 10, 1996, for the following causes of action: (1) breach of contract; (2) bad faith insurance practice; (3) breach of contract accompanied by a fraudulent act; and (4) negligent misrepresentation.
