Swift Eckrich, Inc. (“Swift Eckrich”), appeals from a final judgment entered in the United States District Court1 for the Eastern District of Arkansas upon a jury verdict finding it liable to a number of turkey growers for breach of contract, fraud, breach of the implied warranty of merchantability, and violations of the Packers & Stockyards Act (PSA), 7 U.S.C. §§ 181-228. For reversal, Swift Eckrich argues the district court erred in (1) holding that questions regarding violations of the PSA should not be referred to the Secretary of Agriculture under the doctrine…
