This dispute arises from plaintiffs’ discovery of defects in the residential property that plaintiffs purchased from defendant. On September 3, 2005, plaintiffs received defendant’s Property Condition Disclosure Statement (hereinafter PCDS) pursuant to Real Property Law article 14 and the parties executed a purchase and sale agreement.
