Appeal from an order of the Supreme Court *809(Mulvey, J.), entered October 29, 2009 in Tompkins County, which partially denied defendants’ motion for summary judgment dismissing the complaint.
Defendants, together with their late or former spouses, purchased a four-unit apartment building in the City of Ithaca, Tompkins County in 1973.
