CHAPMAN, Circuit Judge:

This appeal from the Western District of North Carolina involves three separate causes of action; a claim for breach of contract, a fraud claim, and an unfair trade practice claim under N.C.G.S. § 75-1.1. The jury returned verdicts for the plaintiff Santana, Inc. in the amount of $76,122.37 on the contract claim, $203,910 on the fraud claim and $50,000 on the statutory unfair trade practices claim. Defendant Levi Strauss and Co. moved for judgment notwithstanding the verdict on each cause of action. After argument on the motion the district court entered j. n. o. v. on…
