INTRODUCTION
These consolidated matters, Civil No. 96-85 ["Marilyn Action"] and Civil No. 97-185 ["Bertha Action"], were tried before this Court sitting without a jury.
The plaintiff, Mahogany Run Condominium Association [the "Association"], is a condominium association comprising 241 units on the north side of St. Thomas. Defendant Peter D. Beekman ["Beekman"], along with his wife, who is not involved in this matter, is sole shareholder and director of ICG Realty Management Corporation ["ICG"] [collectively "the defendants"].1 Beekman appears to own three units at Mahogany Run in his own name.…
