Douglas Brumm (“Defendant”) was charged by amended felony information with committing the class B felony of assault of a law enforcement officer in the second degree, in violation of § 565.082. 1 After a bench trial, Defendant was found guilty of the lesser-included offense of assault of a law enforcement officer in the third degree, which is a class A misdemeanor. See § 565.083; MAI-CR 3d 319.39. Defendant was sentenced to 180 days incarceration. Execution of the sentence was suspended, however, and Defendant was placed on two years probation and ordered to…
