In an action to recover damages for medical malpractice, etc., the plaintiffs appeal from a judgment of the Supreme Court, Dutchess County (Fagones, J.) dated July 16, 2004, which, upon the granting of the defendants’ motions to dismiss the complaint, made at the close of the plaintiffs’ case, dismissed the complaint.

Ordered that the judgment is modified, on the law, by deleting the provision thereof dismissing the plaintiffs medical malpractice claims against Jack Goodman and Jack Goodman, M.D., EC., for (1) allegedly misreading magnetic resonance imagings of the plaintiffs brain tumor…
